Medify provides a unified clinical trial management platform that enables real-time monitoring, data management, and patient engagement for clinical research. Our Service includes:

3. User Accounts

3.1 Registration

To use certain features of the Service, you must register for an account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate.

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized access or security breach.

3.3 Account Types

Different user roles (investigators, sponsors, patients, monitors) have different access levels and responsibilities as defined in your service agreement.

4. Acceptable Use

• Attempt to gain unauthorized access to the Service
• Interfere with or disrupt the Service or servers
• Use the Service for any fraudulent or illegal purpose

• Share your account credentials with unauthorized parties

5. Data Ownership and Usage

5.1 Your Data

You retain all rights to the clinical trial data you input into the Service. By using the Service, you grant us a limited license to process, store, and display your data solely for the purpose of providing the Service to you.

5.3 Data Backup

While we maintain regular backups, you are responsible for maintaining your own backup copies of critical data.

6. Regulatory Compliance

You are responsible for ensuring that your use of the Service complies with all applicable clinical research regulations, including but not limited to FDA regulations, ICH-GCP guidelines, and local institutional review board (IRB) requirements.

7. Intellectual Property

The Service, including its software, design, text, graphics, and other content, is owned by Medify and protected by intellectual property laws. You may not copy, modify, distribute, or reverse engineer any part of the Service without our express written permission.

8. Payment Terms

If you subscribe to a paid plan, you agree to pay all applicable fees as described in your service agreement. Fees are non-refundable except as required by law or as explicitly stated in your agreement.

9. Service Availability

While we strive for 99.9% uptime, we do not guarantee that the Service will be available at all times. We may suspend or terminate access for maintenance, updates, or other operational reasons with reasonable notice when possible.

10. Limitation of Liability

To the maximum extent permitted by law, Medify shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from:

• Your use or inability to use the Service
• Unauthorized access to or alteration of your data
• Any third-party conduct or content on the Service
• Any interruption or cessation of the Service

11. Indemnification

You agree to indemnify and hold harmless Medify from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of the Service, violation of these Terms, or infringement of any rights of another party.

12. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice, for any reason, including breach of these Terms. Upon termination, your right to use the Service will immediately cease. You may also terminate your account at any time by contacting us.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes by email or through the Service. Your continued use of the Service after such notification constitutes acceptance of the modified Terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with applicable international laws and regulations governing clinical research and data protection. Any disputes shall be resolved through binding arbitration or in the courts of appropriate jurisdiction.
